1. Scope of the General Terms and Conditions (GTC)

The following General Terms and Conditions (GTC) apply to the use of this website and the online shop in the version currently available and valid when the online shop is accessed or when orders are placed.

A customer is any natural or legal person who maintains a business relationship with Angie Acrylics as a buyer or user of the online shop. The GTC, the terms of delivery and payment, the right of cancellation and the data protection provisions may be amended from time to time. Angie Acrylics therefore advises you to read these provisions carefully each time you visit the online shop and each time you order goods.

These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation of Angie Acrylics in order to be valid. By using the online shop (e.g. submitting reviews, using the customer form) or when ordering goods or making an offer, the customer confirms that they fully accept these GTC, including the terms of delivery and payment, the right of cancellation and the data protection provisions.

Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

2. Information on the online shop

The online shop contains information about my self-made products. I reserve the right to make changes (e.g. price, product range and technical changes). All information on the online shop (product descriptions, images, videos, dimensions, weights, technical specifications and other information etc.) are to be understood as approximate values and in particular do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. Angie Acrylics also does not guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is subject to change at any time and without notice.

3. Prices

The prices quoted in the online shop are in Swiss francs (CHF, SFr.). Angie Acrylics is not subject to VAT. Processing and shipping costs and any credit card costs will be charged to the customer during the ordering process, unless otherwise provided for, and shown separately on the invoice. For price, product range and technical changes as well as any other countries, the respective delivery costs will be added. Additional costs for customisations and specifications are either already included in the price or are shown separately with the product and charged to the customer.

Angie Acrylics reserves the right to make technical changes, errors and misprints at any time and without prior notice. Consultancy and support services are not included in the sales prices.

4. Conclusion of contract

The offers in the online shop represent a non-binding invitation to the customer to order products in the online shop. By placing an order via the online shop and accepting these GTC, as well as by paying the amount due by PREPAYMENT, the customer submits a legally binding offer to conclude a contract. Orders are binding for the customer.

As the products are unique, no right of cancellation is granted.

The contract is concluded as soon as Angie Acrylics has confirmed receipt of the advance payment. Payment must be made by the customer within three days.

Orders will only be carefully packed and delivered/shipped after full payment has been received. If it transpires after the conclusion of the contract that the ordered product can no longer be delivered (existing order), Angie Acrylics is entitled to cancel the entire contract. In this case, the payment will be refunded to the customer. Angie Acrylics is not obliged to make a replacement delivery in the event of cancellation of the contract.

5. Payment options and retention of title

The customer can pay by credit card and PayPal via the payment service provider. Payment is made via the specially secured area provided by the payment service provider. The costs for credit cards etc. are charged to the customer based on the shop strategy.

The products remain the property of Angie Acrylics until full payment has been received. Payment must be made by the customer within three days.

6. Delivery, obligation to inspect, notification of defects and returns

Deliveries are dispatched to the address specified by the customer in the order, as noted with the respective product. Upon dispatch, the benefit and risk shall pass to the customer, insofar as this is legally permissible. If the delivery cannot be delivered or if the customer refuses to accept the delivery, Angie Acrylics may cancel the contract after notifying the customer by e-mail and setting a reasonable deadline, and may charge the customer for the costs incurred. The customer is obliged to inspect the delivered goods immediately upon receipt and to notify Angie Acrylics immediately in writing of any defects for which Angie Acrylics is liable. Any damage caused by delivery/shipping (defective packaging) must be recorded photographically before it is removed.

Returns are at the expense and risk of the customer. The customer must send the goods to Angie Acrylics in their original packaging, complete with all accessories and with a detailed description of the defects.

If the inspection by Angie Acrylics reveals that the product has no identifiable defects, Angie Acrylics may charge the customer for the labour involved, the return shipment or any disposal.

7. Warranty

In the event of defects notified in good time, Angie Acrylics warrants the goods purchased by the customer to be free of defects and functional for the statutory warranty period, which is generally two years from the date of delivery. It is at the discretion of Angie Acrylics to fulfil the warranty by repairing the goods free of charge, replacing them with equivalent goods or refunding the purchase price. Further claims are excluded.

The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances.

Angie Acrylics does not guarantee the topicality, completeness and correctness of the data or the constant or uninterrupted availability of the online shop, its functionalities, integrated hyperlinks and other content. Angie Acrylics is not liable for the infringement of third party rights through the use of the online shop or unavailable goods.

8. Exclusion of liability

Angie Acrylics excludes all liability, irrespective of its legal basis, as well as claims for damages against Angie Acrylics and any auxiliary persons and vicarious agents. In particular, Angie Acrylics shall not be liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or financial loss suffered by the customer. Any further mandatory statutory liability remains reserved.

Angie Acrylics only uses hyperlinks to simplify the customer's access to other websites. 

9. Exclusion of liability for links

References and links of third parties on the website and in the online shop are outside the area of responsibility of Angie Acrylics. Any responsibility for such websites is rejected. Access to and use of such websites is at the user's own risk.

10. Data protection

Angie Acrylics may process and use the data collected during the conclusion of the contract to fulfil the obligations arising from the purchase contract and for marketing purposes. The data necessary for the fulfilment of the service may also be passed on to contracted service partners.

11. Copyrights

The copyright and all other rights to content, images, photos, videos or other files on the website and in the online shop belong exclusively to Angie Acrylics or the specifically named rights holders. The written consent of the copyright holders must be obtained in advance for the reproduction of any elements.

12. Additional provisions

Angie Acrylics expressly reserves the right to amend these GTC at any time and to bring them into force without prior notice.

In the event of disputes, Swiss law shall apply exclusively to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is Wallisellen, Switzerland, unless mandatory jurisdiction is provided for by law.
